The Delhi High Court on Wednesday sought the Enforcement Directorate’s (ED) response in a petition filed by AAP convenor and former Chief Minister Arvind Kejriwal, challenging a trial court’s issuance of summons against him in the excise policy case.
Justice Ravinder Dudeja issued notice and posted the matter for next hearing on September 10.
The ED had filed a complaint before a magistrate court after Kejriwal failed to join the probe, despite being issued summons.
Acting on the ED’s complaint, the magistrate court had issued summons to the AAP leader. Following this, Kejriwal appeared before the magistrate and was granted bail. A sessions court had upheld the issuance of summons by the magistrate court last year.
Kejriwal, in pleas before the HC, has now challenged both the magistrate court’s issuance of summons as wellas the sessions court’s orderupholding the issuance of summons.
The ED, in its complaint last year, had blamed Kejriwal for being “non-cooperative”. “Whether it is an ordinary person or a CM, everyone will always have some work or the other, but upon being served with a summons, such a person would be legally bound to attend…,” ED had pointed out.
